General Terms and Conditions

Lainapalikka Suomi Oy - brickborrow.fi

Welcome to Brick Borrow Finland.
We’re here to make building with LEGO® sets fun, easy, and accessible.

Brick Borrow service (hereinafter the "Service") is a LEGO® set borrowing service provided and maintained by Lainapalikka Suomi Oy (hereinafter the "Service Provider") though its website at www.brickborrow.fi.

These Terms and Conditions apply to agreements between the Service Provider and its customers (the "Customer"), as well as to the use of the Service, in addition to the applicable consumer protection legislation. The Terms and Conditions are designed to ensure a smooth and enjoyable experience for all Customers and users of the Service. Use of the Service requires acceptance of these Terms and Conditions. By subscribing the Service, you accept these Terms and Conditions.

Registration for the Service

Placing an order for the Service requires registering as a user. During registration, the Customer must provide accurate and correct contact details, including at least their first and last name, email address, postal address, and phone number. By registering, the Customer confirms that the information provided is true and correct. The Customer must read and accept these Terms and Conditions when registering.

The Service is intended for private use only. The Customer must be an adult individual with a valid credit card. The Service Provider collects and processes the Customer’s personal data for order processing and for maintaining and managing the customer relationship in accordance with its Privacy Policy (www.brickborrow.fi/tietosuoja).

The Customer’s email address provided during registration functions as his/her username, and the Customer chooses a password at the time of registration. The username and password are personal and may only be used by the Customer. They must be stored securely so that unauthorized persons cannot access them. The Customer is responsible for all actions performed using their username and password. If the Customer suspects that someone else is using their credentials, they must immediately change their password and notify the Service Provider.

The Service Provider has the right to require the Customer to change their password without providing a reason. The password must be changed without delay.

Ordering the Service / Membership Subscription

A Customer who has registered for the Service may subscribe to the Service by selecting a membership plan with a recurring fee and providing valid credit card details on the order form. The chosen membership plan determines which LEGO® sets you can borrow, how many at a time, and how often. After placing an order, the membership fee for the selected billing period (monthly or yearly) is charged to the Customer’s credit card. Thereafter, recurring membership fees, shipping costs, and any additional charges are automatically billed on a monthly basis. Payments already charged are non-refundable. If the Customer’s credit card details change, the Customer must place a new order with updated details no later than fourteen (14) days before the start of the next billing period.

The membership subscription is valid until further notice and may be terminated in accordance with the section “Termination of the Membership Subscription”. Returning borrowed LEGO® sets does not end the membership subscription or the Customer’s payment obligations.

Payment Methods

Currently, the only accepted payment method is credit card. Payment processing is provided by Stripe Payments Europe, Ltd. (the "Payment Processor") in cooperation with banks and credit institutions. The Payment Processor holds the required payment institution license within the EEA as required by the Finnish Financial Supervisory Authority. All data transfers and payment transactions are SSL-secured. The Service Provider is not responsible for payment processing and does not collect or store Customer card details.

Membership Subscriptions and Set Selection

Membership subscriptions are billed monthly or annually. The following membership plans are currently available:

  • The Mystery set subscription: Borrow one set selected by the Service Provider for each monthly borrowing period (calculated from the subscription start date). If the set is returned before the next borrowing period begins, the next set will be sent at the start of that new period. The borrowed set may be kept for as long as desired, but borrowing across multiple periods does not entitle the Customer to additional sets simultaneously.

  • The Builder subscription: Borrow one set of the Customer's choice at a time. Any set may be selected, subject to additional conditions for valuable or rare sets as described under "Borrowing Epic Sets".

  • The Master subscription: Borrow two sets of the Customer's choice at the same time. Both sets are shipped together in one delivery and must also be returned together. Any available sets may be selected, subject to the additional conditions for valuable or rare sets as described under "Borrowing Epic Sets".

Changing Your Membership Subscription

To change a membership plan, please contact the Service Provider at info@brickborrow.fi or via the contact form on the website.

Pausing Your Membership Subscription

If the Customer wishes to take pause borrowing and has no sets currently on loan, the Service Provider may be contacted at info@brickborrow.fi or through the website’s contact form. An Annual subscription may be paused for one (1) to three (3) months. The pause extends the subscription term accordingly.

Order Cancellation / Right of Withdrawal under the Finnish Consumer Protection Act

In accordance with Chapter 6, Section 14 of the Finnish Consumer Protection Act (kuluttajansuojalaki, 38/1978), consumers have the right to cancel a distance sale subscription by notifying the Service Provider at info@brickborrow.fi or via the contact form within fourteen (14) days of placing the order.

Because of this withdrawal right, the first borrowed set is shipped only after the withdrawal period has expired. If the Customer requests delivery before the withdrawal period ends, the Customer accepts that the withdrawal right no longer applies once the Service Provider has shipped the first set and fulfilled its obligations. If the Customer exercises the withdrawal right after making such a request, the Customer must pay the Service Provider reasonable compensation for the part of the Service already provided.

Termination of Membership Subscription

A membership subscription valid until further notice may be terminated to expire at the end of the current billing period by notifying the Service Provider at info@brickborrow.fi or through the website’s contact form no later than fourteen (14) days before the end of the billing period. Termination requires that all borrowed sets have been successfully returned. The Customer may not terminate the membership subscription while holding borrowed sets.

The Service Provider may, at its sole discretion and for any reason, terminate the Customer’s membership subscription and require the return of all borrowed sets. If the sets are not returned within the required notice period, the Service Provider may charge the Customer compensation equal to their replacement value.

Gift Cards

Gift cards may only be redeemed against the price of a monthly subscription. Gift card subscriptions are non-refundable. Gift cards must be activated within twelve (12) months from the date of purchase.

Borrowing Epic Sets

Sets containing a large number of pieces, rare sets, or are sets that are otherwise high-value are classified as "Epic sets" and are clearly identified on the website. Customers new to Brick Borrow must complete a three (3) month "apprenticeship" period before borrowing Epic sets. During this period, the Customer must maintain an active subscription and demonstrate responsible borrowing behaviour. This policy is necessary to protect against theft and loss of high-value sets in the initial subscription period. This requirement is waived for Customers subscribed to an annual Builder or Master membership plan.

Delivery of Borrowed Sets

The Service Provider aims to keep delivery costs fair and transparent. A flat delivery fee of 10.00 € is charged per order, covering both shipping and return, regardless of the number or size of sets. Deliveries are available only in Finland, excluding Åland.

Deliveries are primarily handled by Posti. Sets are typically shipped within one (1) to two (2) business days after ordering. Delivery times may vary due to high demand or circumstances beyond the Service Provider's control. Tracking information is provided once the order has been dispatched.

If a shipment is unclaimed or returned in accordance with the carrier's policies, it is treated as if the Customer had received and returned the sets normally. Shipment costs are non-refundable.

The Service Provider is not responsible for loss or damage resulting from incorrect delivery details provided by the Customer. Any resulting loss or damage will be charged at full replacement cost.

Every set is checked for cleanliness before dispatch. When necessary, full cleaning is carried out using hot soapy water and mild detergents to meet hygiene standards.

Using Borrowed Sets and Reporting Missing Parts

Sets must be handled with care and returned in the same condition as received. While reasonable efforts are made to ensure sets are complete, small pieces may occasionally go missing. Missing or damaged pieces must be reported as soon as possible by emailing info@brickborrow.fi or through the contact form. Replacement pieces are sent on Customer request. If a set is returned with unreported missing pieces, replacement costs plus an administration fee of 5.00 € may be charged. Borrowing privileges may be suspended until any outstanding charges are settled.

Only authentic LEGO® products are supplied by the Service Provider. Any non-LEGO pieces should be reported immediately at info@brickborrow.fi or through the contact form.

Returning Borrowed Sets

Each shipment includes instructions and a return shipping label. Following the instructions will speed up the return process and help the Service Provider dispatch the next set. Missing labels must be reported to the Service Provider.

Steps for returning a set:

  1. Dismantle the set into individual pieces.

  2. Place the LEGO® pieces, LEGO® Minifigures, and instructions into the provided, sealable bags. Bigger pieces, like baseplates, may be carefully placed directly in the Brick Borrow box. Note: If the Customer received a new set, the pieces do not need to be separated into the original numbered bags.

  3. Pack all materials into the original shipping box and seal it securely with the sticker or tape provided. If tape was received, dampen the back of the tape to activate the glue.

  4. Apply the return label to the outside of the box and return it via a Posti service point.

Referral Program

Participants receive a unique referral code to share with fellow enthusiasts. When a referred customer completes their first order, the referrer will receive a free shipping code for their next order. The referred friend will receive a free shipping code for their second order.

Referral rewards are non-transferable and can only be used on Brick Borrow Finland orders. The Service Provider reserves the right to modify or cancel the referral program at any time without prior notice. Abuse of the referral program may result in disqualification and revocation of rewards.

Additional Charges for Unreturned Sets and Missing Parts

By agreeing to these Terms and Conditions, the Customer authorizes the Service Provider to charge the payment card on file, or any subsequently updated payment information, for unreturned sets or missing parts. If the Customer is unable to return a set, if parts are missing, or if a set is damaged, the Customer must contact the Service Provider immediately so that alternative arrangements may be explored.

The Customer must return all borrowed sets within fourteen (14) days after giving notice of termination of the subscription. If sets are not returned within this period, the Service Provider may charge the Customer the replacement costs. This charge is processed automatically after the fourteen (14) day period without further notice. Once the payment is successfully processed, the membership is terminated, the account closed, and the sets no longer need to be returned.

The Customer is also liable for deficiencies, damages, and costs discovered after return, including replacement costs of missing parts. If missing parts or damages are unreported, the Service Provider may charge the Customer the cost of replacements plus a 5.00 € handling fee.

Limitations of Liability

By subscribing to the Service and accepting these Terms, the Customer agrees that the Service Provider is not liable for any harm, direct or indirect costs, damage, or loss arising from the purchase, use, or handling of any goods, services, resources, content, or transactions related to the products supplied through the Service.

Some LEGO® sets contain small parts that are NOT suitable for and may pose a hazard to children under three (3) years of age. The Customer is responsible for ensuring safe use.

The Service Provider is not liable for force majeure events that are unforeseeable, beyond its reasonable control, and cannot be overcome with reasonable effort. The Service Provider will notify the Customer of such an event as soon as possible.

Changes to Pricing and Terms

The Service Provider will notify Customers of any pricing changes or substantial changes to the Service content at least thirty (30) days in advance, giving the Customer the option to adjust or terminate their membership. Changes will take effect no earlier than the start of the next billing period. The Service Provider reserves the right to discontinue any membership plan at the end of the current billing cycle.

The Service Provider may update these Terms and Conditions without prior notice. The Customer is responsible for staying informed of the Terms and Conditions and continued use of the Service constitutes acceptance of updated Terms and Conditions.

Governing Law and Dispute Resolution

These Terms and Conditions, the membership subscriptions and any agreements related to the Service between the Service Provider and the Customer are governed by Finnish law, excluding its conflict-of-law rules.

The Service Provider aims to resolve any disputes amicably and primarily through negotiation. If necessary, the Customer may refer disputes to the Finnish Consumer Disputes Board (www.kuluttajariita.fi) or bring a claim before the district court of the Customer's domicile. Before contacting the Consumer Disputes Board, the Customer must first contact the Consumer Advisory Service of the Finnish Competition and Consumer Authority (www.kuluttajaneuvonta.fi).
